On September 1, 2024, Polk County Sheriff’s Office received a tip in regards to a stolen motorcycle out of Winter Haven.
The man in possession of the stolen motorcycle was identified as Cody Huggins of Auburndale, DOB 9/9/1994.
Probable cause lead PCSO to arrest Huggins for Grand Theft Motor Vehicle, Resisting Officer without Violence and Attaching an Unassigned Tag.
It should be noted that this is an unedited report of facts by Polk County Sheriff’s Office. These facts are up for question and everyone is entitled to question the validity of facts by law enforcement in a court of law. “PROBABLE CAUSE:
On September 1st, 2024, I received an anonymous tip in which a Cody Huggins allegedly was in possession of a stolen motorcycle out of Winter Haven. The stolen motorcycle was currently located at REDACTED Drive Auburndale, Florida 33823.
Landline contact was made with the Winter Haven Police Department. I spoke with the on shift supervision, who confirmed a motorcycle was stolen on August 28th, 2024, fromREDACTED Street Northwest in Winter Haven. I learned that the assigned license plate was “REDACTED” and the vehicle identification number to be “REDACTED”, Winter Haven Police Department provided the following case number 24-4619 in connection to this investigation.
Through investigative resources, I learned that Mr. Huggins resides at REDACTED Drive, and has a large amount of distinct identifiable facial and neck tattoos.
On September 02, 2024, at approximately 0032 hours, members of the Polk County Sheriff’s Office (including myself) arrived at REDACTED Drive in Auburndale, Florida. Upon arrival, I immediately noticed a motorcycle to be parked underneath the carport of the residence. As I was walking up for the motorcycle, I observed a male who I immediately recognized as Mr. Huggins open the front door of the residence.
“Polk County Sheriff’s Office” announcements were made to have Mr. Huggins exit the residence. Mr. Huggins retreated into the main residence and closed the door. He continued to ignore announcements to exit the residence.
I then observed the VIN on the motorcycles frame to match the stolen motorcycles VIN. The motorcycle was currently bearing Florida License Plate “REDACTED”. A DAVID inquiry revealed the current attached license plate is registered to a 1991 utility trailer, not the motorcycle. I further observed signs of the motorcycle being originally green, however, spray painted black and blue due to the interior of the chain being green as well as other small parts.
Law Enforcement remained on scene and continued knocking on the residential front door in an attempt to make contact and speak with Mr. Huggins due to the stolen motorcycle being on the residential property. Eventually, a woman named Tracy Stidham exited the residence and identified herself as Mr. Huggins’s mother as well as the home owner. Ms. Stidham was then briefed on the reasoning of Law Enforcement’s presence, confirmed Mr. Huggins was inside the residence, and provided verbal consent for Law Enforcement to enter the residence to detain Mr. Huggins.
Upon entering the residence, members of the Polk County Sheriff’s Office made several announcements and requested that Mr. Huggins exit the residence.
After several loud and clear verbal commands, members of the Polk County Sheriff’s Office Deputies entered the residence, which resulted in Mr. Huggins being located and apprehended.
It should be noted that during this interaction, deputies on scene were wearing their Polk County Sheriff’s Office Class B Uniforms, clearly identifying themselves as law enforcement officers.
Mr. Huggins was provided his Miranda Rights Warning which were read directly from a Polk County Sheriff’s Office agency issued Miranda Rights Warning card. Mr. Huggins advised he understood all of his rights and agreed to speak with deputies about this investigation. Mr. Huggins stated the following information:
Mr. Huggins stated an unidentified “friend” brought the motorcycle to his residence and asked to keep the motorcycle at this location. Mr. Huggins stated he assumed the motorcycle was stolen, however, allowed this “friend” to keep the motorcycle at his residence. I learned Mr. Huggins was permitted to drive this motorcycle by this “friend” in return for providing a storage location for the motorcycle. Mr. Huggins then stated he assumed law enforcement was at his residence due to the stolen motorcycle, which is why he retreated into the residence and refused to come out despite hearing the lawful commands given to him.
The lawful owner of the motorcycle (REDCATED) was notified of our findings and shortly thereafter, arrived on scene. REDACTED confirmed she does not know Mr. Huggins and at no time did she permit him to take the motorcycle.
In conclusion to my investigation, I determined Probable Cause existed to believe Mr. Huggins violated the following Florida State Statutes:
812.014(2)(C)б – Grand Theft Motor Vehicle
843.02 – Resisting Officer without Violence
320.261 – Attaching an Unassigned Tag (Citation #REDACTED)
Mr. Huggins was placed under arrest and transported to the Polk County Sheriff’s Office without further incident.”
